2.1. How to Submit a DMCA Notice

To be effective, your DMCA Notice must be a written communication that includes the following information:
  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on this website are covered by a single notification, a representative list of such works.
  2. Identification of the allegedly infringing material that is to be removed or to which access is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, exact URL(s) and, if possible, screenshots or descriptions).
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or of a person authorized to act on behalf of the owner.

By submitting a DMCA Notice, you acknowledge that we may forward your notice, including your contact details, to the user or third party who posted or provided the allegedly infringing material. Do not submit a DMCA Notice if you do not consent to having your information shared in this way.

2.2. Upon Receipt of a Valid DMCA Notice

Upon receipt of a valid DMCA Notice, this website will:
  1. Take reasonable steps to remove or disable access to the allegedly infringing material;
  2. Notify the user, content provider, or third party associated with the material that it has been removed or disabled; and
  3. In appropriate circumstances, terminate the accounts of repeat infringers and/or remove their content permanently.
This website has no obligation to adjudicate disputes regarding ownership of content. Where there is a dispute, the parties must resolve it directly, and the website will act in accordance with its legal obligations and internal policies.

2.3. Counter-Notification

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a Counter-Notification. To be effective under the DMCA, your Counter-Notification must include:
  1. Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or disabled.
  2. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your full name, mailing address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the courts in your country of residence (or, if you are outside the United States, that you consent to the jurisdiction of the courts located where the service provider may be found) and that you will accept service of process from the person who provided the original DMCA Notice or their agent.
  5. Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we may, at our discretion, forward it to the party who submitted the original DMCA Notice. Unless the original complainant notifies us within a reasonable time that they have filed an action seeking a court order to restrain the user from engaging in infringing activity, we may restore the material that was removed or disabled.

2.4. Repeat Infringers

In appropriate circumstances and at our sole discretion, we may disable and/or terminate accounts or access for users who are determined to be repeat infringers. A “repeat infringer” is a user who has been the subject of multiple valid DMCA Notices.

2.5. Misuse of the DMCA

Submitting false or bad-faith DMCA Notices or Counter-Notifications is a serious matter and may result in legal consequences, including damages and attorneys’ fees under 17 U.S.C. § 512(f). Do not make claims or counter-claims unless you are certain that you have a valid basis and that all information you provide is accurate.
